Photo Release & Liability Waiver

This page is the combined Liability Waiver / Assumption of Risk and Photo & Media Release for the Yetu Triathlon — on Mount Kenya, organised by the Health Yetu Foundation (Dutch stichting, KvK 75590166, RSIN 860333139, Postbus 75879, 1070 AW Amsterdam, the Netherlands) ("Health Yetu", "HY", "we", "us").
Acceptance of both Part 1 (Liability Waiver) and Part 2 (Photo Release) is required to register. Acceptance is captured through dedicated checkboxes in the Jotform registration form on yetutriathlon.com/register. By ticking those boxes and submitting your registration, you confirm that you have read, understood, and agreed to the entirety of this document.
If anything on this page is unclear, do not register until you have written confirmation from us at info@healthyetu.com.
Part 1 — Liability Waiver / Assumption of Risk
1. Activity description
I am voluntarily participating in the Yetu Triathlon — on Mount Kenya, a multi-day high-altitude expedition organized by the Health Yetu Foundation, taking place 2–5 March 2027. The activities include but are not limited to: multi-day trekking to altitudes exceeding 4,985 meters, summit attempts of Point Lenana, kayaking on Lake Ellis (3,300 m, water temperature approximately 5°C), mountain biking on unpaved trails, and running at altitude.
2. Risks I accept
I understand that participation in the Yetu Triathlon involves real and substantial risk, including risk of serious injury and death. The list below is non-exhaustive:
- Altitude sickness, including Acute Mountain Sickness (AMS), High-Altitude Cerebral Edema (HACE), and High-Altitude Pulmonary Edema (HAPE).
- Hypothermia, frostbite, sunburn, snow blindness, and dehydration.
- Falls, sprains, fractures, and other musculoskeletal injuries.
- Drowning, capsize, or cold-water shock during the kayak leg on Lake Ellis.
- Cardiac events triggered by altitude, cold, exertion, or pre-existing conditions.
- Wildlife encounters (Mount Kenya National Park is an active wildlife area).
- Delayed or unavailable emergency evacuation due to weather, cloud ceiling, terrain, or other operational factors.
- Injury during the mountain biking or trail running segments, including on unpaved or technical terrain.
- Exposure to communicable diseases.
- Theft, loss, or damage to personal property.
- Travel disruption, including flight cancellation, weather events, civil unrest, or other political events.
I accept that this list cannot enumerate every possible risk, and I assume all such risks voluntarily, whether or not they are listed above.
3. My responsibilities
By accepting this waiver I confirm and agree that:
- I am 18 years of age or older on 2 March 2027.
- I am physically able to participate. Health Yetu does not require a medical declaration; I have nevertheless considered my own fitness honestly and have consulted my GP where appropriate.
- I hold, or will hold prior to the event, my own travel and medical insurance covering the full duration of my trip, including high-altitude trekking and water-based activities.
- I have considered prophylactic medication (including altitude and malaria medication) and consulted my GP. The choice to take or not take any such medication is mine alone.
- I will follow all instructions given by Health Yetu's licensed guides, the expedition medic, the safety boat crew, and any other operational staff. I understand that ignoring such instructions may result in my removal from the activity at my own risk and cost.
- I will inform Health Yetu in advance of any pre-existing medical condition, allergy, medication, or other factor that could affect my safety or the safety of others on the mountain.
- I will respect Mount Kenya National Park rules and the guidance of the Kenya Wildlife Service (KWS), including all permit conditions, leave-no-trace principles, and wildlife protocols.
4. Limitation of Health Yetu's liability
I release, waive, discharge, and covenant not to sue the Health Yetu Foundation, its officers, employees, volunteers, guides, partners (including Tropic Air, rescue.co, Lions SightFirst Eye Hospital, MP Shah Hospital, Borana, Lewa, Desert Rose, Reteti), and contractors from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury — including death — that may be sustained by me, or to any property belonging to me, while participating in this event, except in the case of gross negligence or wilful misconduct on the part of the Health Yetu Foundation.
5. Insurance
- Supplemental evacuation insurance via rescue.co is arranged and paid for by Health Yetu and is included in the €1,250 participation fee. It provides helicopter and ground evacuation cover for medical emergencies on the mountain. Full terms:
rescue.co. - Personal travel and medical insurance is mandatory and is the participant's responsibility. It must cover the full duration of the trip, high-altitude trekking to at least 5,000 m, and water-based activities. Health Yetu will not register a participant who has not confirmed this in §D1 of the Jotform.
- Insurance does not cover gross negligence or wilful misconduct on the part of the participant. Acting recklessly, ignoring guide instructions, attempting unsanctioned routes, or concealing a relevant medical condition may void cover.
6. Emergency contact
I will designate an emergency contact during registration via the Jotform (fields C1–C3: full name, phone, relationship). I confirm this contact is reachable for the duration of the event window (2–5 March 2027) and may be contacted by Health Yetu, its medic, rescue.co, or local authorities in the event of an emergency. The emergency contact must not be me.
Part 2 — Photo & Media Release / Image Rights
7. Grant of rights
I grant the Health Yetu Foundation, the Yetu Triathlon, and their authorized contractors a non-exclusive, royalty-free, worldwide, perpetual license to photograph, film, record, and reproduce my likeness and any related materials taken during the Yetu Triathlon — on Mount Kenya, and to use these materials for the purposes of fundraising, marketing, public communication, social media, partner reporting, and the aftermovie. I waive any right to inspect or approve such use, and I will not be entitled to any compensation.
8. Where the images may be used
The materials covered by §7 may be used in any of the following channels and any successor channels of equivalent purpose:
- The

healthyetufoundation.comwebsite. - Social media posts and stories on Instagram and LinkedIn under the handle
@healthyetufoundation. - The aftermovie and other video edits, including YouTube and partner channels.
- Sponsor and partner reporting decks.
- Press materials, including releases sent to media outlets in the Netherlands, Kenya, and elsewhere.
- Annual reports of the Health Yetu Foundation.
9. Sensitive imagery
Health Yetu will not use images depicting injury, distress, or unconsented medical situations for marketing purposes. Such images, if captured, will be either deleted or retained solely for internal incident review and insurance documentation, and will not be published.
10. Withdrawal of consent
I may withdraw my consent to future use of my likeness at any time by emailing privacy@healthyetu.com. If that address is unreachable, please use info@healthyetu.com as a fallback. On receipt of a withdrawal request:
- Health Yetu will cease all future use of the relevant materials within a reasonable period.
- Health Yetu cannot retroactively remove materials that have already been printed (e.g. annual reports, partner decks, press kits), already published on third-party platforms beyond HY's control, or archived in social-media posts that pre-date the withdrawal request.
- This right of withdrawal does not affect the lawfulness of processing based on consent before its withdrawal (GDPR Article 7(3)).
11. Acceptance
Acceptance of this Photo Release is confirmed via the dedicated checkbox on the Jotform registration form (/register, field D4: "I accept the photo and media release.") in combination with the Liability Waiver checkbox (field D2: "I accept the Yetu Triathlon liability waiver."). Both checkboxes link to this page.
The date and time of acceptance are recorded by Jotform alongside the submission and retained per the data-retention schedule in yetutriathlon.com/privacy.
Governing law and forum
This document is governed by the laws of the Netherlands, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with this document shall be brought before the competent court of Amsterdam, the Netherlands, subject to any mandatory consumer-protection rules that may apply to the participant's country of residence.
Severability
If any provision of this document is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
